Terms and conditions

1. Introduction

This document sets out the terms and conditions for using the www.dreyacandles.ro website, as well as the conditions that apply to purchasing the products sold through it.

By accessing and using the site and/or by placing an order, the user confirms that they have read this document and accept the terms applicable to their order.

The website operates in accordance with the applicable law of Romania and with the European Union rules applicable to electronic commerce and consumer protection.

2. Seller's details and definitions

2.1. Seller

Hereinafter referred to as "the Seller" or "Dreya Candles".

2.2. Definitions

For the purposes of this document:

• Website / Site – the www.dreyacandles.ro website;
• Seller – Cojocea Andreea Persoană Fizică Autorizată;
• Customer / Buyer / User – the person who accesses the site or purchases products through it;
• Consumer – the natural person acting for purposes outside their commercial, industrial, craft or professional activity;
• Products – scented and decorative candles, scented wax products, wax melts, fresheners and other products sold on the site;
• Order – the request submitted through the site for the purchase of one or more products;
• Distance contract – the contract concluded between the Seller and the Consumer without their simultaneous physical presence, through the site;
• Account – the section of the site accessible to the user, where this functionality is available.

3. Acceptance of the Terms and conditions

Placing an order implies acceptance of the Terms and conditions applicable at the moment the order is made.

The Seller may amend this document where necessary, including to reflect legislative or commercial changes or changes in the functionality of the website.

Amendments will not affect orders already concluded, to which the version of the Terms and conditions valid at that moment applies.

4. Conclusion of the contract

The products displayed on the site represent a presentation of the products available for purchase.

By placing an order, the Customer submits to the Seller the request to purchase the selected products.

The distance contract is deemed concluded at the moment the Seller confirms acceptance of the order, on a durable medium, in accordance with the applicable law.

The Seller reserves the right not to accept an order in justified situations, such as:

• unavailability of the product;
• the impossibility of confirming or processing the payment;
• the existence of manifestly erroneous or incomplete information;
• reasonable suspicion of an attempted fraud;
• obvious technical errors regarding the price or availability of the product.

Where a paid order cannot be fulfilled, the Customer will be informed and the sums paid for the products that cannot be delivered will be refunded.

5. Products and availability

Dreya Candles makes efforts to keep the descriptions, images and information relating to the products as accurate as possible.

Product photographs are for presentation purposes. Depending on the screen, the light, the materials and the particularities of the making process, there may be minor differences in colour, shade, positioning of decorative elements or finish.

In the case of handmade products, small variations between products are normal and do not, in themselves, constitute a lack of conformity.

Product availability is that shown on the site, subject to any technical errors or errors in updating the stock.

6. Particularities of natural wax products

Products made from soy wax or other types of natural wax may show natural variations in appearance.

In the case of soy wax, the phenomenon known as "frosting" may appear, manifested by whitish or crystalline areas on the surface of the wax or on the walls of the container.

Frosting is a natural characteristic associated with the crystallisation of vegetable wax and does not, in itself, represent a lack of conformity of the product, nor does it normally affect its functionality.

Likewise, depending on the temperature and storage conditions, small variations in surface, colour or adhesion of the wax to the container may appear.

This section does not limit the consumer's legal rights, including the right of withdrawal and the rights attached to the legal guarantee of conformity.

7. Prices and payment methods

All prices are shown in Romanian lei (RON) and include the applicable taxes, according to the Seller's tax regime.

The applicable price is the one shown on the site at the moment the order is placed, except in situations where there is an obvious display error.

Payment for the products may be made by:

• bank card, online, through Stripe;
• other electronic payment methods shown on the checkout page at the moment the order is made.

Dreya Candles does not accept cash on delivery or bank transfer, where these methods are not expressly shown on the checkout page.

Card details are processed by the payment services provider. Dreya Candles does not store and has no access to the full bank card details.

Where the gift wrapping service is available, its cost is shown separately and applies to each product for which this option is selected. The cost of gift wrapping is not taken into account towards reaching the threshold required for free shipping, unless otherwise specified on the site.

Any fees charged directly to the Customer by the issuing bank or by other financial providers are independent of the Seller.

8. Delivery

Products are prepared and dispatched after the order and the payment are confirmed.

The estimated delivery time is 2–4 working days, depending on the destination, the availability of the products and the courier service.

Delivery is made within the territory of Romania, through the courier services available on the site.

The standard shipping cost is 19.90 lei.

For orders with an eligible value over 200 lei, shipping is free, except in situations or promotions for which different conditions are displayed.

The cost of the gift wrapping service is not included in the calculation of the free shipping threshold.

Delivery times are estimates and may be affected by situations outside the Seller's reasonable control, including busy periods, weather conditions, logistical problems or other external circumstances.

This provision does not limit the consumer's legal rights concerning the delivery of the products.

9. Right of withdrawal

In the case of contracts concluded at a distance, the Consumer benefits, under the conditions provided by OUG no. 34/2014, from the right to withdraw from the contract within 14 calendar days, without having to justify the decision.

For products bought through the site, the period generally begins on the day on which the Consumer, or a person designated by them other than the carrier, takes physical possession of the product.

To exercise the right of withdrawal, the Consumer must send an unequivocal statement of their decision to withdraw to dreyacandles@gmail.com. A model form is available on the Shipping & returns page, without its use being mandatory.

The products must be sent back without undue delay and within the period provided by law.

The direct costs of returning the products are borne by the Consumer, except where the Seller has agreed to bear them or where the law provides otherwise.

The Consumer is liable only for the diminished value of the products resulting from handling them beyond what is necessary to establish their nature, characteristics and functioning.

In the case of candles and wax products, lighting, burning, melting, cutting or actually using the product leads to a total diminution of its value: the product can no longer be sold. Candles that have been lit and wax melts that have been melted are not accepted back. This provision does not concern non-conforming, wrongly delivered or faulty products, to which section 13 applies.

10. Products exempt from the right of withdrawal

The right of withdrawal does not apply in the cases expressly provided by law.

In particular, it may be excluded for products:

• made to the specifications presented by the Consumer;
• clearly personalised for the Consumer,

under the conditions provided by OUG no. 34/2014.

The mere fact that a product is handmade does not automatically mean that it is exempt from the right of withdrawal.

The natural phenomenon of frosting does not remove the legal right of withdrawal.

11. Refunds in the event of withdrawal

Where the right of withdrawal is validly exercised for the whole order, the Seller will refund the sums paid by the Consumer, including the cost of standard delivery to the Consumer, under the conditions provided by law.

The cost of shipping the products back from the Consumer to the Seller is borne by the Consumer.

If the Consumer has chosen a delivery method more expensive than the standard method offered by the Seller, the additional costs relating to that option will not be refunded.

The refund is made without undue delay and within a maximum of 14 days from the date the Seller is informed of the decision to withdraw, generally using the same payment method used for the initial transaction, unless the Consumer expressly agrees to another method.

The Seller may withhold the refund until the returned products are received or until the Consumer provides proof of their dispatch, whichever situation occurs first.

12. Uncollected or refused orders

The Customer is responsible for providing correct and complete delivery information and for collecting the parcel under the conditions communicated by the carrier.

Where a prepaid parcel is returned to the Seller as a result of the impossibility of delivery or of its not being collected, the situation will be settled in accordance with the applicable law and the specific circumstances of the order.

In the event of repeated and unjustified refusals or failures to collect orders, the Seller reserves the right subsequently to refuse to accept new orders, to the extent permitted by law.

13. Legal guarantee of conformity

The products benefit from the legal guarantee of conformity, under the conditions provided by OUG no. 140/2021 on certain aspects concerning contracts for the sale of goods, as subsequently amended.

The Seller is liable to the Consumer for the lack of conformity of the products under the conditions and for the period established by the applicable law.

A product is in conformity when, among other things, it corresponds to the description and the characteristics presented, can be used for the normal purpose for which it is intended, and has the qualities and characteristics that the Consumer may reasonably expect, taking into account the nature of the product.

Where a lack of conformity exists, the Consumer benefits from the remedies provided by law, including, as the case may be and under the legal conditions:

• bringing the product into conformity by repair or replacement;
• a proportionate reduction of the price;
• termination of the contract and the refund of the price.

The remedies apply in the order and under the conditions provided by the applicable law.

The costs of bringing the product into conformity, including the cost of returning the non-conforming product to the Seller, are borne by the Seller. This rule is distinct from the one in section 11, which concerns withdrawal from the contract, not the lack of conformity.

The legal guarantee of conformity is not a guarantee that a consumable product will remain unconsumed or unchanged throughout the legal period.

In the case of candles and other consumable products, the normal consumption of the product through its use in accordance with its purpose, normal wear, the changes naturally caused by burning or melting, and the natural characteristics of wax such as frosting, do not in themselves represent a lack of conformity.

To report a possible lack of conformity, the Customer may contact the Seller at dreyacandles@gmail.com, stating the order number and describing the problem found.

14. Use and safety of the products

Dreya Candles products must be used solely in accordance with their intended purpose and in compliance with the safety instructions and warnings provided on the product, the packaging, the label or the site.

In the case of candles, the Customer must in particular observe the recommendations concerning:

• supervising the candle while it burns;
• keeping the product away from children, pets and flammable materials;
• placing it on a stable, heat-resistant surface;
• observing the instructions on burning time and wick maintenance;
• not moving the container while the wax is hot;
• stopping use when the safety conditions indicated for the product can no longer be observed.

The Seller is not liable for damage resulting exclusively from improper use, contrary to the purpose of the product or to the instructions and warnings communicated to the Customer, to the extent permitted by law.

No provision of this document excludes or limits the Seller's liability in situations where it cannot be excluded or limited under the law.

15. Limitation of liability

Dreya Candles makes reasonable efforts to keep the information, prices, photographs and descriptions available on the site correct. Technical or material errors may nevertheless occur.

Where an obvious error of price, description or availability is identified before the order is accepted, the Customer will be informed and will be able to decide whether they wish to place or maintain the order under the correct conditions, as the case may be.

The Seller is not liable for damage caused exclusively by:

• use of the products contrary to the instructions and warnings;
• improper storage;
• interventions or modifications made to the product by the Customer;
• external events that cannot reasonably be controlled by the Seller,

to the extent permitted by the applicable law.

No provision of these Terms and conditions is intended to exclude or limit the mandatory rights conferred on the Consumer by the legislation in force.

16. Protection of personal data

Personal data is processed in accordance with the applicable data protection legislation, including Regulation (EU) 2016/679 – GDPR.

The data may be used, as the case may be, for:

• processing and administering orders;
• carrying out payments;
• invoicing;
• delivery;
• communicating with the Customer in connection with orders;
• fulfilling legal obligations;
• sending commercial communications, where there is a legal basis for them.

17. Cookies

The website may use cookies and similar technologies for the operation of the shop, to keep your preferences and for traffic statistics. We do not use marketing cookies or cookies that track you for advertising purposes.

18. Intellectual property

The content of the website, including but not limited to the Dreya Candles brand, logos, photographs, images, graphic elements, texts, product names and original materials, is protected by intellectual property legislation, to the extent that it benefits from such protection.

Copying, reproducing, distributing or using the protected materials without authorisation is prohibited, except in the situations permitted by law or authorised in advance by the rights holder.

19. Force majeure

Neither party will be liable for the non-performance or delayed performance of its obligations where this is caused by an event of force majeure or by other situations recognised by law as exempting from liability.

The affected party will inform the other party within a reasonable time of the situation that has arisen, where this is possible.

20. Complaints and dispute resolution

For any problem concerning an order or a product, the Customer is encouraged to contact Dreya Candles first, at dreyacandles@gmail.com.

We will try to settle any complaint amicably.

Consumers may also address the Romanian National Authority for Consumer Protection (ANPC): anpc.ro and may use the Alternative Dispute Resolution (SAL) mechanisms: reclamatiisal.anpc.ro, available under the legislation in force. The European consumer redress page is also available: consumer-redress.ec.europa.eu.

Where the dispute cannot be settled amicably, it will be settled by the courts having jurisdiction under Romanian law.

This provision does not limit the consumer's rights concerning the jurisdiction of the courts as established by law.

21. Applicable law

These Terms and conditions and the contracts concluded through the website are governed by Romanian law and, where applicable, by the mandatory European Union rules on consumer protection.

Should a provision of this document become void, inapplicable or contrary to a mandatory legal provision, the remaining provisions remain applicable to the extent permitted by law.
